Öz

1915 olaylarını soykırım olarak nitelendiren ulusal veye uluslararasıbir mahkeme kararı bulunmuyor. Tam aksine, soykırım iddialarını çürütenbir uluslararası mahkeme kararı vardır. Birinci Dünya Savaşı sonuitibariyle, 144 Osmanlı görevlisi İngilizlerce “Ermenilere yönelik toplumkatliamlar” yapmak suçlamasıyla tutuklanmış ve Malta’da Britanya’nın enyüksek hukuki otoritesi olan Londra’daki İngiliz Kraliyet Başsavcılığı’ncabir soruşturma yürütülmüştür. İngiliz hükümetinin Malta’daki Türktutukluları yargımaka ve mahkum ettirebilmek için verdiği tüm uğraşlararagmen, İngiliz Kraliyet Başsavcılığı’nın yürüttüğü soruşturma “bir İngilizmahkemesi önünde bu tür suçlamaların kanıtlanması mümkün değildir”gerekçesiyle hiçbir suçlama yapılmadan sonuçlanmıştır. Ermeni soykırımıiddialarını hukuki ve tarihi açıdan tamamıyle çürüten bulguları ile Maltayargılamaları tarihimizde çok önemli bir yer tutmaktadır. Ancak bu yaunuttuğumuz ya da bize unutturulmuş bir olaydır

(THE MALTA TRIBUNALS)

Öz

There is no national or international court ruling characterizingthe 1915 events as genocide. On the contrary, there is an international courtruling in hand which refutes the genocide claims. By the end of the FirstWorld War, 144 Ottoman officials were arrested by the British on thegrounds that they had “perpetrated mass killings against Armenians,” anda legal investigation was initiated on Malta conducted by Britain’s highestlegal prosecution authority, the Crown Prosecution Service (CPS) inLondon. Despite the British government’s every effort to try and sentencethe Turkish detainees on Malta, the CPS inquiry resulted in no chargesbeing filed, on the grounds that “it was unlikely that such charges could beproven in a British court of law.” The Malta Tribunals, with their judicialand historical findings that refute the Armenian genocide claims as a whole,constitute an important chapter in our history. Yet it is a chapter that wehave forgotten and were made to forget
