Hukukun İktisadi Analizi Çerçevesinde Rekabet Hukuku

Öz

Hukukun iktisadi analizi, hukuk kuralları ve kurumlarının değerlendirilmesinde mikro iktisat araçlarını kullanan disiplinlerarası bir yaklaşımdır. Bu analizin temel amacı, “toplam iktisadi etkinlik”
olarak tanımlanan sosyal refahın artırılmasıdır. Bu analiz, hukukun farklı alanlarında kullanılan bir
yaklaşım olmakla birlikte, bilhassa Amerika Birleşik Devletleri rekabet hukukunda önemli bir etki yaratmıştır. Hukukun iktisadi analizinin, Avrupa Birliği rekabet hukukunda da uygulanmasına yönelik
olarak literatürde ve politika geliştiren Komisyon’da tartışmalar yapılmaktadır. Bu makalede, öncelikle, hukukun iktisadi analizinin iktisadi ve hukuki temelleri incelenecektir. Daha sonra, bu analizin Amerika Birleşik Devletleri rekabet hukukunda, özellikle refah ekonomileri ve Chicago Okulu’nun etkisiyle
uygulanışı ele alınacaktır. Son bölümde ise, bu analizin Avrupa Birliği rekabet hukuku ve politikasıyla
uyumu tartışılacaktır.

Öz

The economic analysis of law is an approach which applies the methods of microeconomics to the
analysis of legal rules and institutions. The main purpose of this analysis is to maximise social
welfare which is defined as total economic efficiency. This analysis has been widely used in United
States Antitrust Law. There are ongoing debates as whether this approach should also be applied in
European Union competition law. This article examines the economic analysis of law and its impact on
United States Antitrust enforcement through the influence of welfare economics and Chicago School.
It then discusses whether it should also be enforced in European Union competition law.
