BİYOTEKNOLOJİK BULUŞLARIN PATENTLENMESİ

Öz

Teknolojinin hızlı ilerlemesi sonucu biyoteknoloji alanındaki baş döndürücü gelişmeler yaşanmaktadır. Bu gelişmeler, pek çok hukuki düzenlemeyi gerektirdiği gibi aynı zamanda da kamu düzeni ve ahlak kuralları ile ilgili tartışmalara da yol açmaktadır. Uzun yıllardır süren biyoteknolojik buluşun patentlenebilirliği sorunu, COVID 19 pandemisi ile birlikte daha da hararetli bir hale gelmiştir. COVID 19 pandemisinin dünya genelinde yarattığı yıkıcı sonuçlar üzerine acil aşı ve ilaç geliştirme çalışmalarına başlanmıştır. Yeni teknikler kullanılarak geliştirilen bu modern aşılar, biyoteknolojik buluşların bir sonucudur ve patent koruması altındadır. Gelişmekte olan veya az gelişmiş ülkelere aşının yeterli seviyede ulaştırılamaması, bu buluşa ilişkin patent korumasının kaldırılması talebine yol açmıştır. Fakat güvenilir bir aşının geliştirilmesi ve üretimi süreci son derece masraflıdır. Biyoteknolojik buluşlar yalnızca aşılar ile de sınırlı değildir, başlıca kullanım alanları; sağlık sektörü, tarım, hayvancılık ve gıda sanayidir. Biyoteknolojik buluşlar, canlı organizmaların oluşumu ve gelişimi ile ilgili olduğundan beraberinde pek çok etik endişeyi de taşımaktadır. Tüm bu tartışmalar, biyoteknolojik buluşların patentlenmesi şartlarının ve patentlenebilirliğin istisnalarının değerlendirilmesi gerekliliğini ortaya koymaktadır.

PATENTING OF BIOTECHNOLOGICAL INVENTIONS

Öz

As a result of the rapid progress of technology, there are stunning developments in the field of biotechnology. While these developments require many legal regulations, they also lead to discussions about public order and moral rules. The problem of patentability of biotechnological invention, which has been going on for many years, has become even more heated with the COVID 19 pandemic. Upon the devastating consequences of the COVID 19 pandemic worldwide, urgent vaccine and drug development studies were initiated. Developed using new techniques, these modern vaccines are the result of biotechnological inventions and are under patent protection. The insufficient delivery of the vaccine to developing or underdeveloped countries has led to a demand for the removal of patent protection for this invention. But the process of developing and producing a reliable vaccine is extremely costly. Biotechnological inventions are not limited to vaccines, their main areas of use are; health sector, agriculture, animal husbandry and food industry. Since biotechnological discoveries are related to the formation and development of living organisms, they also carry many ethical concerns. All these discussions reveal the necessity of evaluating the conditions for patenting biotechnological inventions and the exceptions to patentability.
