İslam Hukukunda Kişisel ve Toplumsal Hak İhlalleri Karşılığında Öngörülen Cezalar İle İbadet Kapsamındaki Cezaların Mukayesesi

In this work, the punishments in Islamic Law which are prescribed against civil in juries and public offenses are compared with devotional punishments. Similar and different points are presented. The crimes and punishments that are explained in Quran and Sunnah with detail such as murder, adultery, false accusation of adultery, theft (serika), offenses aga inst public safety (hırâbe) and usage of intoxicants are compared with devotional punish ments prescribed against violations during pilgrimage and fasting. The reasons behind the punishment system which predicts a variation in punishment according to the qualities of crimes in the first group are investigated together with the reasons behind the punishment system which offers alternatives according to the capacity of the wrongdoer in cases of the second group.

Bu çalışmada İslam hukukunda toplumsal ve kişisel hak ihlalleri karşılığında ön görülen cezalar ile ibadetler kapsamındaki cezalar mukayese edilmekte, benzer ve farklı yönler ortaya konulmaktadır. Kur’an ve Sünnet’te ayrıntılı olarak açıklanan, kasten adam öldürme, zina, iffete iftira, hırsızlık, (serika) terör, (hırâbe) sarhoşluk verici maddeleri kullanma suç ve cezaları ile oruç ve hac ibadetlerindeki ihlaller karşılığında öngörülen cezalar inceleme konusu yapılmaktadır. Birinci grupta yer alan cezalardaki suça göre farklılık gösteren ceza yapısına karşılık, ibadetlerle ilgili cezalarda failin gücüne göre değişen seçimlik cezaların nedenleri araştırılmaktadır.
