Norman Calder’ın Studıes In Early Muslım Jurısprudence Adlı Eseri Çerçevesinde Şarkiyat Literatüründe Muvatta’ın Tarihlendirilmesi

Hadis ve fıkıh kaynağı olarak Muvatta’, erken döneme ait önemli eserler arasında yer almaktadır. Müslümanlar kadar Batılı araştırmacıların da ilgi odağında yer alan İmam Mâlik’in Muvatta’ı, şarkiyat literatüründe daha ziyade telif edildiği dönem itibariyle tartışma konusu edilmiştir. Muvatta’ın tarihlendirilmesi bağlamında kendisine en fazla atıfta bulunulan çalışma, Norman Calder’ın Studies in Early Muslim Jurisprudence adlı eseridir. O, bu kitapta Muvatta’ ile Müdevvene’nin şeklî özellikleri hakkındaki farazî yorumları netice sinde Muvatta’ı, hicrî III. yüzyıla tarihlendirmektedir. Bu makalede sözü edilen kitap çerçevesinde Calder’ın yöntemi ve ulaştığı neticeler tasvirî bir şekilde verilmeye çalışılacaktır.

As a source of hadīth and fiqh, al-Muwatta’ takes its place among the important treatises in the early period of Islam. Imam Mâlik’s al-Muwatta’, which is the focus of interest for the Western scholarship as much as for Muslims, has been examined in the Orientalist wri tings significantly in relation to the date of its original composition than to its content. With respect to the dating of al-Muwatta, the most important reference work is Norman Calder’s Studies in Early Muslim Jurisprudence. In this book, he dates al-Muwatta’ to the third century A.H., because of his speculative findings about the similar structural characteristics between al-Muwatta’ and al-Mudawwana. In this article, focusing on the above-mentioned book, I will try to give Calder’s method in a descriptive manner, while analyzing his conclusions on the subject.
