Informed Consent Challenges in Cross-Cultural Medical Tourism: A Narrative Review of Language, Legal, and Ethical Barriers in Patient Decision-Making

Objective: This study aims to examine how informed consent processes in medical tourism—driven by cost advantages and timely access—are compromised in cross-border care due to language discordance, divergent legal frameworks, and ethical-cultural tensions. It further seeks to evaluate the implications of these structural challenges for patient safety and autonomy. Materials and Methods: This study was designed as a narrative review based on high-impact academic literature, patient safety guidance from the World Health Organization, and analytical reports from the Organisation for Economic Co-operation and Development. Thematic analysis was conducted focusing on linguistic barriers, jurisdictional discrepancies, and the influence of cultural norms on disclosure, comprehension, and voluntariness within informed consent processes. Results: Language discordance was found to significantly impair patients’ understanding of procedural risks, benefits, and alternatives. Jurisdictional mismatches between countries limit patients’ legal recourse and may weaken their capacity for autonomous decision-making. Moreover, tensions between relational (collectivist) norms and individualistic models of autonomy complicate disclosure practices and voluntariness. Superficial or proceduralized consent processes were associated with increased risk of patient harm, unrealistic expectations, and erosion of trust. Conclusion: Strengthening informed consent in medical tourism requires integrated strategies, including multilingual decision aids, certified medical interpreters, transparent legal disclosures, and cultural humility training for healthcare providers. Harmonization of minimum standards, regulatory oversight of facilitators, and future intervention-based research are essential to transform medical tourism into a more equitable and autonomy-respecting model of cross-border care.

Tıbbi Turizmde Bilgilendirilmiş Onam Zorlukları: Dil, Hukuki ve Etik Engellerin Hasta Karar Verme Sürecine Etkisi Üzerine Bir Anlatısal Derleme

Öz

Amaç: Bu çalışma, maliyet avantajı ve hızlı erişim gibi nedenlerle artan medikal turizm uygulamalarında, sınır ötesi bakım süreçlerinde bilgilendirilmiş onamın dil uyumsuzluğu, farklı hukuki düzenlemeler ve etik-kültürel gerilimler nedeniyle nasıl zayıfladığını incelemeyi amaçlamaktadır. Ayrıca hasta güvenliği ve özerkliğin korunması açısından mevcut yapısal sorunları analiz etmeyi hedeflemektedir. Gereç ve Yöntem: Bu araştırma, yüksek etki faktörlü literatür, World Health Organization hasta güvenliği rehberleri ve Organisation for Economic Co-operation and Development analizleri temel alınarak hazırlanmış bir anlatı derlemesidir. Dil bariyerleri, yargı alanı farklılıkları ve kültürel normların onam sürecine etkileri tematik olarak değerlendirilmiştir. Bulgular: Dil uyumsuzluğu hastaların tedavi risklerini ve alternatiflerini yeterince anlamasını engellemekte; farklı ülkeler arasındaki hukuki çerçeve farklılıkları hastaların hak arama yollarını ve özerk karar verme kapasitesini sınırlamaktadır. Ayrıca ilişkisel (kolektivist) kültürel normlar ile birey merkezli (otonomiye dayalı) etik anlayış arasındaki gerilimler, bilgilendirme ve gönüllülük süreçlerini karmaşıklaştırmaktadır. Yüzeysel onam uygulamalarının hasta zararına, gerçekçi olmayan beklentilere ve güven kaybına yol açabileceği görülmektedir. Sonuç: Medikal turizmde etik ve hukuki açıdan sağlam bir bilgilendirilmiş onam süreci için çok dilli karar destek araçları, sertifikalı tercüman kullanımı, şeffaf hukuki bilgilendirme ve kültürel yetkinlik eğitimi gereklidir. Asgari standartların uyumlaştırılması, aracı kurumların düzenleyici denetime tabi tutulması ve müdahale temelli gelecekteki araştırmalar, medikal turizmin daha adil ve hasta özerkliğine saygılı bir bakım modeline dönüşmesi açısından kritik öneme sahiptir.
