Osmanlı Hukukunda Konsolos: Eğriboz Örneği (1714-1815)

Öz

Osmanlı Devletindeki konsolosluk hukukuna ilişkin ticari örfler ve konsolosu kabul eden devletlerin tanıdığı statü, meselenin hukuk doktrininde ele alınmasından tarihsel olarak önce gelmektedir. Bu nedenle konsolos gönderen veya kabul eden devletlerin düzenlemeleri ve uygulamaları önem taşımaktadır. Benzer bir kurum olan elçilik dünya tarihinde çok eski dönemlere dayanırken konsolosluk on sekizinci yüzyılda büyük yaygınlık kazanmıştır. Konsolos uygulamasının hukuki altyapısının gelişmesi ve konsoloslara ilişkin hukuki değerlendirmelerin artışı ise Osmanlılarda on dokuzuncu yüzyılda görülmüştür. Dolayısıyla o döneme kadar konsoloslar hakkında Osmanlılarda ayrıntılı ve bütünlüklü hukuki görüşler pek görülmemiştir. Ahitnameler başta olmak üzere normlar ve bürokratik uygulamalar daha çok yer bulmuştur. Bu makalede, Osmanlı Devletindeki konsolos varlığı ve faaliyeti üzerindeki hukuki vurguyu artırmak amaçlanmaktadır. Makalede, Tanzimat öncesi Osmanlı devletler hukuku ve uygulamalarında konsolosun yerine değinilmiştir. Daha sonra, on beşinci yüzyıldan on dokuzuncu yüzyıl başlarına kadar Osmanlı Devletinde bulunan konsoloslar ve konsoloslara bağlı çalışanlar hakkındaki tarih literatürünün görünümü ele alınmış, aynı yüzyıllar içinde Osmanlı egemenliği altındaki Eğriboz’un siyasi ve sosyo-ekonomik durumu özetlenmiştir. Makalenin üçüncü kısmında, on sekizinci yüzyılda ve on dokuzuncu yüzyılın başlarında Eğriboz’da konsolos bulunduğuna işaret eden Osmanlı bürokratik yazışmaları tanıtılmıştır. Aynı kısımda, Eğriboz’daki konsolosların dava tarafı olarak bürokratik yazışmalarda zikredildiği bazı vakalar analiz edilmiştir.

Consul in Ottoman Law: The Case of Euboea (1714-1815)

Öz

The commercial customs regarding consular law in the Ottoman Empire and the status recognized by the states accepting the consuls shaped before legal scholars addressed the issue. For this reason, the regulations and practices of the states that send or receive consuls were significant. While the embassy, a similar institution, dates back to ancient times in world history, the consulate became widespread in the eighteenth century. The development of the legal infrastructure of the consul practice and the increase in legal evaluations regarding consuls existed in the Ottomans in the nineteenth century. Therefore, until that period, one could not confront detailed and complete legal opinions about consuls in the Ottoman Empire. Norms and bureaucratic practices, especially ahitnames (covenants), have found more space. In this article, I seek to increase the legal emphasis on the consul‟s presence and activity in the Ottoman Empire. First, I will handle the consul‟s place in pre-Tanzimat Ottoman law and practices. Then, I will discuss the historical literature on consuls and consular employees in the Ottoman Empire from the fifteenth century to the early nineteenth century and I will summarize the political and socio-economic situation of the island of Euboea under Ottoman rule in the same centuries. In the third part of the article, I will introduce Ottoman bureaucratic correspondence indicating the consul‟s presence in Euboea in the eighteenth and early nineteenth centuries. In the same part, I will analyze cases in which consuls cited in bureaucratic correspondence as litigants.
