Democracy Through Law Or Law Through Democracy? Reflections On The Relationship Between Law And Democracy

“Democracy through law” formula refers to the application of legal procedures in establishing, protecting and consolidating democratic order. On the other hand, the concept of “law through democracy” emphasizes that democratic procedures and principles shall be applied in the preparation, adoption and application of legal rules. Although the formula of “democracy through law” is widely accepted in theory and practice, the concept of “law through democracy” is not commonly used and endorsed by the doctrine. This paper analyses the democratic transition and consolidation through law, “law through democracy” approach and the probable impacts of cosmopolitan democracy over national legal systems in a general framework

Hukuk Yoluyla Demokrasi mi, Demokrasi Yoluyla Hukuk mu? Hukuk ve Demokrasi İlişkisi Üzerine Değerlendirmeler

Öz

“Hukuk yoluyla demokrasi” formülü, demokratik düzene geçiş, demokratik düzenin korunması ve pekiştirilmesinde hukuki yolların kullanılmasını ifade etmektedir. Buna karşılık “demokrasi yoluyla hukuk” ifadesi, hukuk kurallarının hazırlanması, kabulü ve uygulanmasında demokratik usul ve esaslara uyulmasını vurgulamaktadır. “Hukuk yoluyla demokrasi” formülü doktrin ve uygulamada yaygın kabul görse de, “demokrasi yoluyla hukuk” doktrinde sıkça kullanılan ve yerleşmiş bir kavram değildir. Bu çalışmada, hukuk yoluyla demokrasiye geçiş, hukuk yoluyla demokrasinin korunması ve pekiştirilmesi, demokrasi yoluyla hukuk yaklaşımı ve kozmopolit demokrasinin ulusal hukuk düzenleri üzerindeki olası etkileri, genel bir çerçevede incelenmektedir.
