The Turkish Civil Code provides for two different periods of time for the husband to file a suit for disavowal of paternity: Firstly, a period of one year running from the knowledge of the birth and learning the fact that either he is not the father or the mother was cohabitating with someone else at the time of conception, secondly a period of five years that begins with the birth of the child. The Turkish Constitutional Court has invalidated the five years period of time referring to the principle of the rule of law, the right to protection of the moral and physical existence and especially the right to seek justice guaranteed by the Turkish Constitution. The decision of the Court has been followed by the annulment of the time limitation for the child to file a paternity suit, despite the possibility of period restitution in case of reasonable grounds. This article analyzes the pertinence of the decisions of Turkish Constitutional Court, taking into consideration the provisions of Swiss law and the opinion of the Federal Court on the subject matter

Le Code civil turc prévoyait deux délais pour l’action en désaveu de paternité intentée par le mari: Le délai d’un an qui commence dès la connaissance de la naissance et le fait qu’il n’est pas le père ou qu’un tiers a cohabité avec la mère à l’époque de la conception, et le délai de cinq ans qui commence dès la naissance de l’enfant. Le Conseil constitutionnel turc a annulé celui de cinq ans en se référant au principe de l’Etat de droit, au droit de protection de l’existence physique et morale et surtout au droit d’agir en justice garantis par la Constitution turque. Cette décision d’annulation est suivie par l’annulation du délai prévu pour l’action en paternité intentée par l’enfant, malgré la possibilité de la restitution de celui-ci en cas de l’existence des justes motifs. Cet article essaie d’analyser la pertinence des décisions d’annulation du Conseil constitutionnel turc, en tenant compte des dispositions du droit suisse et l’opinion du Tribunal fédéral sur le sujet.
