Culpa in Contrahendo in The Lex Mercatoria

Parties of the international trade relations usually sign the contract after long negotiations. It’s obvious that parties have number of responsibilities after the conclusion of the contract. Inspite of this, it’s not easy whether they’re liable for the damages before the conclusion of the contract. At the present time, some countries acknowledge culpa in contrahendo doctrine for the damages of the other party during the contract negotiations. It's a contradictive topic whether this kind of liability is applicable in the field of lex mercatoria or not.
Recently, the rules, namely, lex mercatoria is considered again in the field of international trade, even though there’s no agreement on its legal character and scope. This study mainly searches whether there’s a base for culpa in contrahendo among these rules called lex mercatoria. In this direction, UNIDROIT Principles, Principles of European Contract Law and Trans-Lex Principles are examined and evaluated in order to determine the basis of culpa in contrahendo within the scope of lex mercatoria.
