Foreign Marriages in Turkey Legal Validity and Results of Consular Marriages

For the validity of a marriage contract, which is a family law contract, it is not enough that only the parties have the capacity to marry and that there are no barriers to marriage, in other words, only the material circumstances of the marriage. Besides, the formal conditions of the marriage must also be respected. The formal conditions of the marriage are regulated in the provisions between Articles 134 and 144 of the Turkish Civil Code, in the Civil Registry Services Act and in the Regulation on Marriage. Among the provisions between Articles 134 and 143 of the Turkish Civil Code, the marriage of Turkish citizens is arranged in the presence of the Turkish authorities. In the period prior to the 1985 Regulation of Marriage, the competence to marry of a foreign consul in Turkey is recognized only in the context of the consular agreements concluded with Turkey, while the 1985 Regulation of Marriage also gave the foreign representatives the right to marry their citizens in Turkey. Today, the authorities authorized to marry foreigners and the limit of the authorities’ right to marry in Turkey will be determined within the framework of the Marriage Regulation under Article 144 of the Turkish Civil Code, Civil Registry Services Act and bilateral consular agreements concluded by Turkey. Within the scope of this work, (1) the authorities authorized to marry foreigners in Turkey, (2) limits of these authorities related to the competence to marry regarding to marriage place and citizenship of the parties, (3) the validity of the consular marriages when the consular or diplomatic representatives exceeds the limits of competence to marry in terms of citizenship of the parties shall be examined.
