Summary Dismissal Procedure Within the ICSID Arbitration

Öz

By way of summary dismissal procedure which is definedunder Rule 41/5 of the ICSID Arbitration Rules, a partymay, nolaterthan 30 days after of the Tribunal, and in any event before the first session of the Tribunal, file an objection that a claim is manifestly without legal merit. Thus, frivolous claims can be dismissed by the tribunal at the outset of the proceeding and consequently the parties save costand time. Application of summary dismissal procedure to ICSID cases has increased considerably in recent years and also other arbitration institutions have begun to introduce their expedited procedures to dismiss claims summarily in a similar manner. This article provides an overview of summary dismissal procedurewithin the ICSID arbitration by examining of Rule 41/5 of the ICSID Arbitration Rules in the light of the decisions given by tribunals.
