ANAYASAL ÇATIŞMA VE ASİMETRİK DESANTRALİZASYON: İSPANYA'DA KATALAN STATÜSÜ KRİZİ

Öz

Bu çalışma, 2006 Katalan Özerklik Statüsü’nün (Estatut) kapsamını daraltan Anayasa Mahkemesi’nin 31/2010 sayılı kararı ile 2017 bağımsızlık referandumuna giden süreç arasındaki nedensel ilişkiyi incelemektedir. Çalışma, kararın yalnızca belirli hükümlerin iptaliyle sınırlı teknik bir değerlendirme olmadığını, aksine İspanya’daki bölgesel çoğulculuk rejiminin sınırlarını yeniden tanımlayan yapısal bir dönüm noktası olduğunu savunur. Kararın; kimlik, dil politikası, mali özerklik ve yargı alanlarında katı bir merkeziyetçi yorum benimseyerek Katalonya’nın özerklik projesinin kurucu unsurlarını geçersiz kılması, Statü’nün sahip olduğu demokratik meşruiyet ile anayasal hukukilik arasındaki gerilimi derinleştirmiştir. Bu durum, siyasi temsil kurumlarına duyulan güvenin aşınması, hukuki belirsizliklerin artması ve siyasi diyalog kanallarının tıkanmasıyla birleşerek, geleneksel özerklik talebinin kitlesel bir bağımsızlık hareketine dönüşmesinde belirleyici olmuştur. Çalışma, 2010–2017 dönemini; meşruiyet krizinin toplumsal mobilizasyonu nasıl hızlandırdığını, siyasi aktörlerin stratejik davranışlarını nasıl yeniden şekillendirdiğini ve anayasal düzen ile demokratik temsil arasında çözülmesi güç bir ikili kriz yarattığını gösteren bir süreç-izleme analiziyle ele almaktadır. Sonuç olarak makale, mevcut çıkmazın yalnızca hukuki araçlarla çözülemeyeceğini, İspanya’nın çoğul uluslu yapısını açıkça tanıyan federal bir anayasal yeniden yapılanma veya karşılıklı rızaya dayalı siyasal müzakere mekanizmalarının kalıcı çözüm için zorunlu olduğunu ileri sürmektedir.

CONSTITUTIONAL CONFLICT AND ASYMMETRIC DECENTRALIZATION: THE CRISIS OF THE CATALAN STATUTE IN SPAIN

Öz

This article adopts a dual analytical framework, integrating a critical examination of the 2010 Constitutional Court ruling (STC 31/2010) with an analysis of the political dynamics that unfolded between 2010 and 2017. Rather than presenting novel empirical data, the study provides a comprehensive assessment of how the Court's decision reconfigured the territorial balance of power, delegitimized the reform of the Catalan Statute of Autonomy, and precipitated a broader constitutional crisis within the Spanish ‘State of Autonomies.’ The analysis demonstrates that the ruling exacerbated deep-seated structural tensions arising from jurisdictional ambiguities, fiscal asymmetries, and the limited recognition of Spain's plurinational character. These structural factors, compounded by the economic crisis and eroding institutional trust, catalyzed the transformation of traditional autonomy-oriented Catalanism into a mass pro-independence movement, culminating in the unilateral referendum of October 2017. The article argues that this crisis underscores a fundamental dissonance between Spain's constitutional architecture and the imperatives of regional pluralism. Consequently, it concludes that sustainable conflict management requires substantial constitutional reform—potentially via a federal reconfiguration—or renewed political dialogue addressing both institutional asymmetries and societal grievances.
