Öz

Mültecilerin Hukuki Durumuna Dair Cenevre Sözleşmesi, mülteciye dair basit bir tanım sunar ve sorun da töre cinayeti gibi ciddi insan hakkı ihlali olan durumların, bu Sözleşmede meşru olarak mülteci tanıması sağlayacak temellerden birine dâhil edilemediği durumlarda ortaya çıkar. Töre cinayetleri genellikle özel ya da aile içi bir durum olarak görülmüştür ve mevcut tanımlar ile Cenevre Sözleşmesi’nin yorumu içinde cinsiyete dayalı zulmün tanınması önündeki engel de, bu zulmün yapıldığı “Üçüncü Dünya” ülkelerinin kültürel farklılıkları olduğu görüşüdür. Birleşik Krallık, sığınma talebinin temeli olan töre cinayeti sebebiyle korkuyu “belli bir toplumsal gruba mensubiyet” kriterine göre değerlendirir. Ancak “belli bir toplumsal gruba mensubiyet” i yorumlamak için yargı mercilerince kullanılan metotlar, töre cinayetlerine dayalı sığınma taleplerinin yargılamasını olumsuz etkileyen ve tutarsız hükümlere ve adil olmayan farklılıklara yol açan bir uygulama birliğinin eksikliğini ortaya koymaktadır
