COMPARISON OF ALTERNATIVE DISPUTE RESOLUTIONS IN ISLAMIC LAW TO TURKISH FAMILY LAW

Abstract

The subject of the study is the legal nature of alternative dispute resolution methods used within the scope of Islamic family law in terms of marriages about to be terminated, and to what extent these methods can be applied in terms of primary and secondary consequences arising as a result of the termination of the marriage. In this study, the methods of conflict resolution and Islamic family law are studied as a part of alternative dispute resolution within the contemporary context. In this respect, mediation and arbitration methods that are planned to be implemented in Turkish family law are adressed with a comparative perspective from the Islamic law approach, a different legal system. The conclusions can be summarized as follows: the scope of alternative dispute resolutions in the Islamic family law covers the end of union of marriage, which is the primary result of divorce. Also, it's impropable to apply mediation or arbitration methods to secondary results due to definitive provisions of the Qur'an and Sunnah, which are considered as main sources of Islamic law. On the other hand, result of conflicts are not taken into consideration within the contemporary mediation and arbitration methods. Instead, these contemporary methods are applied in order to accelerate and ease the process. Therefore, within the scope of contemporary methods, it is improbable to conclude that there is an effort that solely aims to maintain the marriage union. However, in the Islamic family law, it is probable to conclude that the sole aim is to maintain union of marriage and that mediation methods are applied to preserve unity.
