THE IMPLICATIONS OF AN EMPLOYEE’S TERMINATION OF EMPLOYMENT THROUGH RECEIPT OF OLD-AGE OR DISABILITY PENSION OR LUMP-SUM PAYMENT FOR TRADE UNION LAW
Öz
The rights of employees to form trade unions, to join a trade union, or to engage in trade union activities constitute one of the fundamental concepts of collective labour law. However, an employee’s receipt of an old-age or disability pension, or their separation from employment through a lump-sum payment, gives rise to legally contentious consequences with respect to trade union rights. For instance, the question of whether employees who have left employment due to retirement may form a “retirees’ trade union” is a matter debated both in judicial decisions and in legal doctrine, particularly considering Article 90, final paragraph, of the 1982 Constitution, which determines the position of international treaties concerning fundamental rights and freedoms within the hierarchy of norms. Likewise, the fate of an employee’s active trade union membership upon retirement, whether their duties on the union’s executive or supervisory boards continue, and how trade union rights are affected in the event of re-employment following retirement are further issues that warrant separate examination. In this study, in light of international instruments, domestic legislation, and judicial decisions, the following matters will be addressed within the framework of both national law and international treaties: whether retirees may form a trade union; the legal fate of trade union membership for employees who leave employment due to retirement; the status of trade union rights where a retiree resumes employment by paying social security support premiums; and the trade union activities in which retirees may engage.
