Bir Kısım Kur’ân Ahkâmının Tarihsel Olduğu ve Değişmesi Gerektiği İddialarına Eleştirel Bir Yaklaşım

Miladın 610 yılında bütün insanlara peygamber olarak gönderilen Hz. Muhammed (s.a.s) kendisine veri-len Kur’ân ahkâmını bizzat hem kendisi uygulamış hem Müslüman olanların uygulamalırnı sağlamış ve örnek bir toplum oluşturmuştur. Hz. Peygamberin vefatından sonra Müslümanlar, Kur’ân ahkâmını özel, aile ve toplum hayatında uygulayarak medeniyetler oluşturmuşlardır. Zamanla Kur’an ahkâmının hayata yansımasında oluşan zaaflar sonucu gerileme başlamış ve Müslümanlar, birliklerini ve güçlerini kaybetmişlerdir. Batı kültürü, medeni-yeti ve sanayiinin gelişmesi karşısında gereken ilerlemeyi sağlayamayan İslam dünyasında Kur’ân ahkâmının özel-likle muamelatla ilgili hükümlerinin değişmesi tartışmaları başlamıştır. Bu tartışmaya, Batı karşısında mağlup olma-nın ve gelişememenin sebebi olarak İslam’ın görülmüştür. Mekkeli müşrikleri gibi Yuhanna ed-Dimaşkî ile başla-yan Kur’an’ın Allah sözü olmadığı iddiaları Petrus Alfonsi ve Rudi Paret gibi Yahudi ve Hıristiyan oryantalistler tarafından sürdürülürken, İslam dünyasında bazı şahsiyetler, Kur’an’ın bir kısım ahkâmının tarihsel olduğunu ve değişmesi gerektiğini ileri sürmüşlerdir. Özellikle muâmelât ve sosyal hayatla ilgili âyetlerdeki hükümlerin değiş-mesi gerektiğini ileri sürenler, âyetleri “maslahat” ve “makâsıd” açısından ele almışlardır. Maslahat ve makâsıd konusunu dile getirenlerden biri olan Hanbelî fakihi et-Tûfî Kur’ân ve Sünnetle maslahatın çelişebileceğini, böyle bir durumda maslahatın tercih edileceğini savunmuştur. Çağımızda nasla maslahat çelişirse maslahatın tercih edileceği ve ahkâmın değişmesi gerektiği görüşünü Pakistanlı Fazlurrahman, Faslı el-Câbirî, Mısırlı Nasr Hâmid Ebû Zeyd, Hasan Hanefi ve daha başka düşünürler savunmuştur. Bu görüşte olanlar, nasların yani âyet ve hadislerin lafzî delaletlerinin değil, bu lafızlarla gerçekleştirilmek istenen gaye ve maksatların esas olduğunu savunmaktadır-lar. Hatta tarihselciler, değişimin namaz ve hac gibi ibadetler için de söz konusu olduğu görüşündedir. Hâlbuki sahabe döneminden günümüze kadar İslam âlimlerinin kahir ekseriyetine göre bir konuda nas varsa hüküm bu nassa göre verilir. Çünkü naslarda ahkâm, insanların yararını sağlamak ve zararlarını gidermeye yöneliktir. Bu itibarla maslahat ve nas birbirleriyle çelişmez. Kur’ân ahkâmını Peygamber dâhil hiçbir kimse değiştirilmez. Bu makalede bir kısım Kur’ân ahkâmının tarihselliğini ve değişmesi gerektiğini savunanların görüşleri eleştirel bir bakışla değerlendirilmiştir.

A Critical Approach to the Claims that Some Quranic Rulings are Historical and Need to Be Changed

Sent as a prophet to all mankind in 610 AD, Prophet Muhammad (peace be upon her) personally im-plemented the Quranic commandments given to her, ensured their application by Muslims, and created an exemplary society. After the Prophet's death, Muslims built civilizations by applying the Quranic precepts in their private, family, and social lives. Over time, weaknesses in the application of the Quranic precepts to daily life led to decline, and Muslims lost their unity and strength.In the Islamic world, which has failed to keep pace with the development of Western culture, civilization, and industry, discussions have begun regarding the need to change the rulings of the Quran, particularly those related to transactions. This debate has led to Islam being seen as the reason for the defeat and lack of development in the face of the West. While claims that the Quran is not the word of God, beginning with John of Damascus and continued by Jewish and Christian orientalists such as Peter Alfonsi and Rudi Paret, some figures in the Islamic world have argued that some of the Quran's rulings are historical and need to be changed. Those who argued that the rulings in verses related to transactions and social life should be changed have examined the verses from the perspective of "maslahat" (public interest) and "makasid" (objectives). One of those who addressed the issue of maslahat and maqasid was the Hanbali jurist al-Tufi, who maintained that maslahat might conflict with the text, and that in such a case, maslahat should be pre-ferred. In our time, the view that if a religious text (nass) conflicts with expediency (maslahah), expediency should be preferred and the rulings should be changed, has been defended by thinkers such as the Pakistani Fazlur Rahman, the Moroccan Muhammad Abid al-Jabiri, the Egyptian Nasr Hamid Abu Zayd, Hasan Hanafi, and others. Those who hold this view argue that the purpose and intention intended by the literal meaning of the verses and hadiths, rather than their explicit interpretation, are what matter. Even historicists believe that change is possible even for acts of worship such as prayer and pilgrimage. However, according to the vast major-ity of Islamic scholars from the time of the Companions to the present day, if there is a religious text (nass) on a matter, the ruling is given according to that text. Therefore, expediency and divine decree do not contradict each other. On the other hand, the Quran is the word of God; therefore, no one, including the Prophet, can change the word of God. If it is changed, the changed ruling ceases to be a ruling of the Quran. This article criti-cally evaluates the views of those who argue for the historicity and need for change of some Quranic rulings.
