SUBJECTIVITY OF “WELL FOUNDED FEAR OF BEING PERSECUTED” CRITERIA AS A KEY FACTOR FOR DETERMINING THE REFUGEE STATUS

Öz

As a key factor for determining the refugee status according to the Article I-A(2) of the 1951 Convention Relating to the Status of Refugees the term “well-founded fear” contains a subjective and an objective element and in determining whether well-founded fear exists, both elements must be taken into consideration. In this paper, it will be tried to observe the subjectivity of the definition of refugee status with the phrase of “well-founded fear of being persecuted” and to make suggestions to deal with this problematic mostly in the manner of implementation.
