THE FIRST LAW ON CONSUMER RIGHTS: “THE LAW OF THE MUNICIPALITY OF BURSA”

The activities of Akhism that connects the basic
principles of the Islamic religion with Turkish customs and traditions have
continued for centuries. Standards established and implemented by the
organization of the Akhi in commercial life became legal norm with the imperial
rule during the Ottoman period. This legal norm, published under the name “Kanunnama
Ihtisabı Bursa” (The law of the municipality of Bursa) in 1502, is the first
consumer law which have been made in history. “Kanunnama Ihtisabı Bursa” is
also the world’s first standard law. This law entered into force by order of Sultan
Bayezid II. In this law, agricultural products, textile products,
agricultural-cereal products, forest products, leather products, prices and
qualifications are standardized. The rules like dyeing, packaging, quality, and
price restrictions and penal provisions are similar to the practices of the our
age. “Kanunnamai Ihtisab-ı Bursa” has provided important data on activities
related to world standard history and consumer rights. Because the standards
and consumer rights are on the agenda with a high frequency nowadays, it is
important to examine this law. In this article, it is aimed to evaluate the
provisions contained in the law, in the context of the basic principles of
Islamic law which was the source for the Ottoman laws.
