This article include an ethical analysis of a case involving many ethical issues, such as elderly autonomy, proxy consent, limits of proxy consent, and the inability to obtain full and valid informed consent. 84-year-old, female. After the trafic accident, she was unconscious, operation is recommended because of the traumatic subarachnoid hemorrhage. But the patient's legal representative reject to operation as a treatment option. The patient dies after 62 hours and her relatives who refuse the treatment complain to the prosecutor's office about the physicians in the treatment team on the grounds that they cause death after this development. It is thought that evaluation of clinical ethics will contribute to the literature in order to set an example for clinicians who are faced with such situations by discussing the many ethical issues that the case for which autopsy was requested from forensic medicine. Especially in our country, the number of surgical procedures applied to elderly patients is gradually increasing and many difficulties are experienced in the informed consent process in the elderly patient group. In this study, we aimed to draw attention to the difficulties in the informed consent process, which has become an increasingly large problem with the increase in the elderly population.
