TESVİYECİLER MANİFESTOSU: BİR SİVİL ANAYASA ÖNERİSİ Anayasal Demokrasi ve Anayasal Hukuk Devletine Yönelik Eşsiz Bir Yazılı Anayasa Metni

Öz

Tesviyeciler, İngiliz İç Savaş yıllarında bir grup insan tarafından başlatılmış olan bir halk hareketinin adıdır. Tesviyeciler mücadeleleri sonunda İngiltere'nin Özgür Halkının Anlaşması (1649) adını taşıyan bir manifesto yayınlamışlardır. Bu manifesto içerisinde monarşinin kaldırılması, genel ve eşit oy sistemine dayalı bir parlamentonun oluşturulması, nispi temsil sistemi, zorunlu askerliğin sona erdirilmesi ve tüm insanlara eşit haklar ve özgürlükler sağlanması konularında hükümler bulunmaktaydı. Tesviyeciler halk iradesine dayanan ve meşruiyeti olan bir siyasal yönetimin tesis edilmesini amaçlıyorlardı.

Bu çalışma Tesviyeciler hareketinin yayınlamış olduğu bildirge ya da manifestoda yer alan önemli kararları ve hükümleri incelemektedir. Çalışmamızda ayrıca Tesviyeciler bildirgesi ile Magna Carta Libertatum, Haklar Dilekçesi, Habeas Corpus ve Haklar Bildirgesi arasında da bir karşılaştırma yapılmaktadır. Tesviyeciler hareketinin mirası anayasal demokrasi ve hukuk devleti düşüncesidir ve bu hareketin başlangıcı doğrudan halk olmuştur.
