GERONTOKRASİ, DEMANSKRASİ ve OTOKRASİ RİSKLERİNE SİGORTA OLARAK “YAŞ SINIRLAMASI KURALI” Devlet ve Hükûmet Başkanlığı Makamına Seçilecekler İçin Görev Süresi ve Dönem Sınırlamasına İlave Anayasal Yaş Sınırlaması Önerisi

Öz

Görev süresi sınırlaması, dönem süresi sınırlaması ve yaş sınırlaması demokrasinin patolojik patinajlar içerisinde sürünmesini ve otokrasiye doğru evrilmesini engelleyecek kurallar arasında yer alır. Bugün medeni olarak tanımladığımız gelişmiş ülkelerde görev süresi sınırlaması ve dönem sınırlamasına ilişkin kurallar anayasalarda güvence altına alınmıştır. Milletvekillerinin parlamentoda kaç dönem görev yapabilecekleri hususu da sadece sınırlı sayıda ülkenin parlamentolarında benimsenen ve uygulanan bir kuraldır. Yaş sınırlaması ise maalesef dünyanın neredeyse tamamında sadece minimum yaş yeterliliği olarak tarif edilmiştir. Maksimum yaş sınırlaması henüz dünyada benimsenen bir kural haline gelmiş değildir. Bu kısa makale içerisinde demokraside gözlemlediğimiz patolojik sorunlar ve otokrasi risklerine karşı bir sigorta olarak yaş sınırlaması konusu ele alınmaktadır.
