The purpose of this study is to examine the historical development and legal basis of the land readjustment method based on Article 18 of Zoning Law No. 3194, and to evaluate the effects of the amendments introduced by Laws No. 7181 and 7534 on the acquisition of public areas.
In this study, Reconstruction plan implementation methods were briefly explained, and the advantageous and disadvantageous aspects of these methods were emphasized. Of the methods of implementary reconstruction plan, a special focus has been placed on the land readjustment. In this study, the historical development of the interruption called the contribution partnership share (CPS) in land readjustment, which takes its legal basis from Article 18 of the zoning law numbered 3194, and the advantages of the land readjustment method in terms of real estate owners are discussed. In this study, the importance of bringing accessory areas and public spaces to the public through the land readjustment method, with some changes made in the zoning laws with the laws no. 7181 and 7534, is emphasized and the role of zoning practices in obtaining public areas is emphasized. In addition, in this study, a development plan implementation registered in the Gölhisar district of Burdur province was considered in terms of the reinforcement areas provided to the public. As a result, the land readjustment method offers a more equitable approach in the acquisition of public facilities and public areas. The arrangements made with the laws numbered 7181 and 7534 will create a fairer process for both the public budget and private property owners.
In conclusion, the findings indicate that land readjustment constitutes an equitable and effective model for obtaining public areas, as further demonstrated by the implementation example in Gölhisar.
