Hukuk Reformu Metinleri 18: Adliyenin Islahına Dair Komisyon Raporu (9 Mart 1896)
Ottoman Legal Reform Texts 18: Commission Report on the Reform of the Judiciary (9 March 1896)
Öz
This report was prepared upon the instruction of Sultan Abdulhamid II by a commission consisting of jurists who were well-versed in the problems of the judicial system. The report identifies two main reasons for the complaints regarding the judiciary: the failure to implement certain legal regulations concerning judges and judicial officials, and the incompatibility of some of the procedures and principles adopted from Europe with the "temperament" of the public and the country. The primary issues identified include the inability to employ qualified personnel in courts, the quantitative insufficiency of educated and "examined" jurists, the lack of qualifications among members elected by the public, certain rules of procedural law causing delays in lawsuits, the Court of Cassation working contrary to its establishment purpose, the unlawful prolongation of detention periods, the indictment procedure leading to abuses, and prosecutors failing to fulfill their administrative duties properly. Explicitly criticizing provincial courts, the report emphasizes that all judges must be appointed by the Sultan for their rulings to be effective, and lists duties falling upon the Ministry of Justice, such as establishing a control mechanism named "Encümen-i Teftiş" (Inspection Committee), to implement and consolidate the reforms.
