AN EVALUATION OF INNOVATIONS TO HIGHER EDUCATION INSTITUTION DIRECTORS’, INSTRUCTORS’ AND OFFICERS’ DISCIPLINARY REGULATIONS

Abstract

Disciplinary Regulations no. 17789 Regarding Higher Education Institution Directors, Instructors and Officers, effective by August 21, 1982 (“Regulations”) was amended by Regulations no 28897 Amending Disciplinary Regulations Regarding Higher Education Institution Directors, Instructors and Officers, effective by January 29, 2014. Processes concerning disciplinary offences committed by higher education institution staff have been conducted in accordance with the amendments since January 29, 2014. This paper reviews the amendments by considering the substantive rules of disciplinary proceedings to be conducted after the Regulations issued under articles 53 and 64/a-9 of Law no. 2547 on Higher Education and by mentioning the differences between the situations before and after the Amendment

Öz

21.08.1982 tarih ve 17789 sayılı Resmi Gazete’de yayımlanarak yürürlüğe giren Yükseköğretim Kurumları Yönetici, Öğretim Elemanı ve Memurları Disiplin Yönetmeliği (Yönetmelik), 29.01.2014 tarih ve 28897 sayılı Resmi Gazete’de yayımlanarak yürürlüğe giren Yükseköğretim Kurumları Yönetici, Öğretim Elemanı ve Memurları Disiplin Yönetmeliğinde Değişiklik Yapılmasına Dair Yönetmelik (Değişiklik) ile değişikliğe uğramıştır. 29.01.2014 tarihinden itibaren, yükseköğretim kurumu personelinin işlemiş olduğu disiplin suçlarına ilişkin işlemler, bu değişiklikler çerçevesinde yürütülmektedir. Çalışmamızda, söz konusu değişikliklerin; 2547 sayılı Yükseköğretim Kanunu’nun 53 ve 65/a-9 uncu maddelerine dayanılarak çıkarılan Yönetmelik’te meydana getirdiği son durum çerçevesinde yürütülecek disiplin soruşturmalarına ilişkin esaslar; dayanak kanun maddeleri göz önüne alınarak, Değişiklik’ten önceki ve sonraki durum arasındaki farklara değinilerek incelenecektir
