Cultural Defense: Concept and Arguments

This article deals with the meanings attributed to the concepts of “cultural offense” and “cultural defense” in the legal literature, and with the arguments raised in favor of or against the recognition of the cultural defense. The debate surrounding the issue figures out the conflicting premises of the legal ideas, the difficulty in balancing them and in realizing that balance in the criminal courts of contemporary multicultural societies. The compelling need to overcome the problems of clush of cultures forces the legal systems to change or to adopt new forms of interpretation in line with multicultural social reality.

Bu makale hukuk literatüründe “kültürel suç” ve “kültürel savunma” kavramlarına verilen anlamları ve kültürel savunma lehine ya da aleyhine geliştirilen argümanları konu edinmektedir. Konuya ilişkin tartışma hukuki fikirlerin çatışan öncüllerini, bunlar arasında denge kurmanın ve bu dengeyi çağdaş çokkültürlü toplumların ceza mahkemelerinde gerçeğe dönüştürmenin zorluklarını ortaya koymaktadır. Kültürler çatışmasının yarattığı sorunların üstesinden gelmeye yö- nelik ihtiyaç, hukuk sistemlerini değişmeye ya da çokkültürlü sosyal gerçeklikle uyum halinde olan yeni yorum biçimlerini benimsemeye zorlamaktadır.
