Abstract

After the amendment made with the Reform Bill, the change wanted to be made in
the decision of the court of first intance with the recourse of appeal can be justified
as long as the assertion of new means of offence and defence in the instance
of appeal is permissible, too. If the demand of eviction of the plaintiff becomes
due after the end of the hearing in the court of first instance earliest, the plaintiff
can assert this in the instance of appeal.

Abstract

Reform Kanunu ile yapılan değişiklikten sonra da yeni iddia ve savunma araç-
larının istinaf aşamasında ileri sürülmesi caiz olduğu ölçüde istinaf başvurusu
ile ilk derece mahkemesinin kararında yapılmak istenen değişiklik gerekçelendirilebilir.
Davacının tahliye talebi en erken ilk derece mahkemesi önündeki sözlü
yargılamanın bitiminden sonra muaccel hale gelmişse davacı bunu istinaf aşamasında
ileri sürebilir
