Right to Defense & Counsel for the Defense in the Turkish-Islamic Historical Perspective

The proclamation of the republic in 1923 was the beginning of a new legal system in Turkiye. However, the famous edict of the administrative & the legal reforms called the 1839 Tanzimat Fermanı was the beginning for inception of the western legal reforms. Therefore the Ottoman Empire and its juridical system can be analysed in two different parts methodologically, i.e. the Classical (pre-Tanzimat) and the Tanzimat periods. In this study, we tried to focus on the criminal procedural system of the Ottoman Empire from the perspective of the defendant via the right to defense & the counsel for the defense in a panoramic way. The dominant Islamic understanding of the Hanafi School and their interpretation of the legal concepts has influenced the mind-sets of the founders & the jurists of the Turkish Republic, if not the instutions, with regards the the rights of the defendant and the counsel for the defense.

1923 yılında Cumhuriyet’in ilanu ile Türkiye’de yeni bir hukuki dönem başlamıştı. Ama asıl hukuki ve idari reformların başlangıcı Osmanlı Dönemi’nde 1839 Tanzimat Fermanı’nın ilanına tekabül etmektedir. Bu yüzden Osmanlı Dönemini’ni tarihsel metodoloji açısından Klasik Dönem (Tanzimat Öncesi) ve Tanzimat Dönemi olarak incelemek doğru bir bilimsel yaklaşımdır. Elinizdeki çalışma, Osmanlı ceza yargılaması sistemine sanık açısından özellikle savunma hakkı ve müdafi bağlamında bakmaya çalışmıştır. Belirtmeliyiz ki Osmanlı’nın hakim hukuki anlayışı olan Hanefi Öğretisi, Türkiye Cumhuriyeti’nin ceza muhakemesi sisteminde savunmaya yaklaşımı kurumsal olarak olmasa bile, Cumhuriyet’in kurucularının ve hukukçularının zihni kurguları bağlamında olumsuz olarak etkilemiştir.
