The Option of Parlimentary with “President ”System and Its Applicability in Turkey

2007, there has been a significant change in 1982 Constitution regarding the procedure to appoint the president of Turkey. This significant change, known as “367 Event”, made it crucial to conduct a discussion about our country’s political system. According to this amendment, as an actor in the government system, the president’s duties and powers will not be changed but elegation method will be changed. With this newly established system, the unaccountable branch of the government, who is the president will be elected by the public vote. In contemporary world, it is not possible to say that electing the president by public vote is a common practice. Thus, it will be possible to understand this system by examining these rare examples. This study, is pursuing to examine Bulgaria’s governmental system as an example for Turkey. While examining the governmental systems, actors of this system and their relationships to each other will be regarded. Also, “The Constitution within real life” phenomenon will be mentioned as far as it is necessary.

1982 Anayasası’nda 2007 yılında yapılan, siyasal tarihimize” 367 olayı” olarak geçen Cumhurbaşkanı seçimi sürecinden çıkış olarak gündeme gelen Anayasa değişikliği ile ülkemiz açısından yepyeni bir siyasal sistem, tartışılmadan yaşanması zorunlu hale gelmiştir. Yapılan değişiklik hükümet sisteminin aktörlerinden Cumhurbaşkanının, 1982 Anayasası’nın yürürlüğünden itibaren tartışılan yetkilerine dokunmadan sadece seçilme yöntemini değiştirmektedir. Oluşan bu yeni sistem ile yürütme organının sorumsuz kanadı Cumhurbaşkanı, artık halk tarafından seçilecektir. Dünya’da pek de örneği olmayan bu sistemin anlaşılması bu az örneklerin incelenmesi ile mümkündür. 1991 tarihli Bulgaristan Anayasası ile Cumhurbaşkanını halkın seçeceği belirlenen Bulgaristan hükümet sisteminin işleyişini Türkiye açısından örnek olarak incelemeyi amaçlayan çalışmada, hükü- met sistemlerini irdelerken sistemin işlemesini sağlayan aktörler ve bu aktörlerin arasındaki ilişkiler ile yeri geldikçe sistemin işlemesini sağlayan “yaşayan anayasa” unsurlarına da değinmeye çalışılacaktır
