RULE OF POLITICS

Abstract

Rule of law is presented as one of the pillars of good governance. However, law is not a self-generating phenomenon; its concretisation is made by humans. What makes difference at this point is the basic attitude of legal actors, in fact of all persons involved in the legal world, that is, whether they are justice-oriented or self-oriented. Justice-orientedness relies upon an ontological perspective in which humanity is inseparable. There cannot be any real good for one party when another party or the whole is fundamentally harmed. Rule of law is meaningful only in such a mental framework. Otherwise, law and justice are to become victims of rule of politics, in which participants demonstrate all the subtle and crude, individual and collective forms of destructive selfishness.
