SİYASET DEVLETİ

Rule of law is presented as one of the pillars of good governance. However, law is not a self-generating phenomenon; its concretisation is made by humans. What makes difference at this point is the basic attitude of legal actors, in fact of all persons involved in the legal world, that is, whether they are justice-oriented or self-oriented. Justice-orientedness relies upon an ontological perspective in which humanity is inseparable. There cannot be any real good for one party when another party or the whole is fundamentally harmed. Rule of law is meaningful only in such a mental framework. Otherwise, law and justice are to become victims of rule of politics, in which participants demonstrate all the subtle and crude, individual and collective forms of destructive selfishness.

“Hukuk devleti” terimini farklı açılardan ele alan çalışmanın amacı, bu kavramın Türkiye özelinde sosyal gerçekliğini ve geçerliliğini tartışmaktır. Hukuk, salt mevzuat ve formalite kapsamında değil, düşünce ve davranışları şekillendiren bir tavır ve tutum olarak görülürse, hukuk devleti de bu tavrın hakim olduğu devlet olacaktır. Hukuk tavrı, kişilerin ince-kaba, açık-gizli benlik kaygılarına takılmadan, “benimseme” ve “kendinden ayırma” duygularının etkisi altında kalmadan, hakkaniyet odaklı hareket etmesidir. Hukuk tavrının karşıtı olarak yansıttığımız siyaset tavrında ise kişiler, kuşatıcı hakkaniyet ve genel iyilik dışındaki amaçlara yönelmekte ve önlerine çıkan şeyleri bu amaçlar doğrultusunda araçsallaştırmaktadır. Siyaset devleti, böyle tavır ve tutumların egemen olduğu bir kültürü, o kültürün sahne olduğu toplumsal ve devletsel olguları ifade etmektedir. Bu anlamda Türkiye bir hukuk devleti değil, siyaset devletidir
