Abstract

Horizontal and vertical condominium in Turkey has been increased in recent years in harmony with the growth of construction sector via Property Ownership Law numbered 634 published in the Official Gazette in 1965 come into forced since 1966. Population growth rate, economic growth rate and growth of urban areas make possible to get growth of construction across. Considering the proclaim of Turkish Republic in 1923 and first Civil Law in Turkey numbered 743 in 4 October 1926, it should be considered the how the conduct of affairs of condominium subjects. Because it could be thought more land, less population to whom lived in extremely houses with garden, independent house or structure in taking into account Ottoman’s time and the beginning of Turkish Republic, condominium might not require to ownership transformation. Could condominium be needed until 1966 in areas where there was only intense commercial activity, high acquisition and construction cost? Thanks to Gönhan constructed in Ottoman time located in Trabzon Province Center in Çarşı District, transformation process from aerial right into condominium process will be examined to be answered to this question with this study. As a result; a real right known as the aerial right, which was established in the form of an easement, will be evaluated within the context of condominium with regards to legal and technical perspective. One of the most important results of the study is that land shares allocated to independent units with together performing the land valuation for all independent units in the transformation process of property ownership type. The first thing to legally be done have to been allocated land shares with the harmony of market value for all independent units both modern structure and cultural assets.
