Feshe itiraza ilişkin davalarda hükmün uygulanması bakımından tercihin davalıya bırakılmış olması bu davanın sınıflandırılmasını zorlaştırmış ve medeni usul hukukunda yer alan dava türlerinden ayrılmasına neden olmuştur.
