Feshe İtiraz Davası

One of the most important tools for performing job security contested dissolution case. Feshe itiraz davası iş güvencesi kapsamında işçiyi korumayı amaçlayan araçların başında gelir. Ancak bu dava medeni usul hukukunun temel ilkeleri ve özelliklerine uygunluk bağlamında bazı sorunlar içermektedir. Feshe itiraza ilişkin davalarda hükmün uygulanması bakımından tercihin davalıya bırakılmış olması bu davanın sınıflandırılmasını zorlaştırmış ve medeni usul hukukunda yer alan dava türlerinden ayrılmasına neden olmuştur.
