Abstract

Türk yargı sisteminin, ayrımcı pratikler ve güçle bütünleşmiş olmak gibi pek
çok problemi bulunmaktadır. Pek çok durumda tanık olduğumuz gibi, yasama,
yargı organı ve sosyal yapıya dair bir eleştiri getirmeden, kendi başına bu tür
problemleri çözemez. Dahası, yargı sisteminin aktörleri bu ayrımcı pratikleri
kendileri üretmektedirler. Problemin kökenine inmek ve yargının baskıcı
boyutunu açığa çıkarmak için yargı sisteminin erkeksi karakterini analiz etmek
gerekir. Bu çalışmada, Aiskhylos’un Orestes üçlemesi yargı erkinin erkeksi karakterini
göstermek üzere seçilmiştir. Orestes, toplumu ve geleneği dönüştürücü
karakteri nedeniyle, Yunan tragedyalarının en önemlilerinden ve iz bırakmış
olanlarındandır. Orestes’te hem Antik Yunan’daki politik ve sosyal yaşamın
sorgulanışı hem de ideolojik politik ve sosyal durumu yöneten ve meşrulaştıran
ideolojik araçlara ve hukuk sisteminin inşasına tanık oluruz. Yargı sistemi ve
erkeksi iktidar eşzamanlı bir biçimde, mitos yoluyla tesis edilmiştir.

GENDERING JUDGEMENT FROM MYTHOS TO LOGOS AND THE MASCULINE CONSTRUCTION OF LAW To Didem Yaylalı and all the victims of masculine judgement.

Abstract

Turkish judicial system has many problem in the sense of discriminatory
practices and integrating power. As we witness many case, legislation can not
solve this kind of problems without critics about social structure and judicial
organ. Furthermore, the actors of judicial system produce this discriminatory
practices by themselves. It should be an analysis on the masculine character of
judicial system to explore the roots of the problem and reveal the oppressive
dimension of judical function. In this study, Aeschylus’ trilogy of Oresteia has
selected to indicate the masculine character of judiciary power. The Oresteia
is one of the most important and influential of all Greek dramas due to it has
a transformative character in society and tradition. In Oresteia, we witness the
trial both as reflection on the political and social life in Ancient Greece and
ideological instrument used in conducting and justifying the political and social
situation; and constituting a juridical system at the same time. Judicial system
and masculine power has simultaneously established by mythos.
