Firar Suçu İşlemiş Kişilerde Askerliğe Elverişlilik ve Ceza Sorumluluğu

Abstract

Amaç: Bu çalışmada, firar suçu işlemiş bireylerde askerliğe elverişlilik ve ceza sorumluluğu ile sosyodemografik, klinik ve kriminal özellikler arasındaki ilişkinin incelenmesi amaçlanmıştır.
Yöntem: Veriler hastane kayıtlarından elde edilerek retrospektif olarak tasarlanan çalışmaya, 2016–2025 yılları arasında askeri sağlık kuruluna yönlendirilen firar suçu sanığı dahil edilmiştir.
Bulgular: 82 sanık çalışmaya dahil edilmiştir. Katılımcıların önemli bir kısmında madde kullanım öyküsü ve cezaevi geçmişi bulunmasına rağmen, bu değişkenler ile askerliğe elverişlilik arasında anlamlı ilişki saptanmamıştır (p>0,05). Askerliğe elverişsiz olarak değerlendirilen bireylerin tamamında psikiyatrik tanı bulunmuş olup, en sık antisosyal kişilik bozukluğu ve diğer kişilik bozuklukları saptanmıştır (p<0,001). Ceza sorumluluğu ile askerliğe elverişlilik arasında anlamlı ilişki bulunmamış, elverişsiz grubun çoğunluğunda ceza sorumluluğunun tam olduğu görülmüştür.
Sonuç: Firar suçu işlemiş bireylerde askerliğe elverişlilik kararının büyük ölçüde psikiyatrik tanılarla ilişkili olduğu, buna karşın ceza sorumluluğundan bağımsız değerlendirilmesi gerektiği anlaşılmaktadır. Ayrıca, ceza sorumluluğu değerlendirmesinin çoğu durumda ek katkı sağlamayabileceği ve yargılama sürecini uzatabileceği düşünülmektedir.

Military Fitness and Criminal Liability of Persons Who Committed the Crime of Desertion

Abstract

Objective: This study aimed to examine the relationship between military fitness, criminal responsibility, and sociodemographic, clinical, and criminal characteristics in individuals charged with desertion.
Method: This retrospective study, which utilized data obtained from hospital records, included individuals accused of desertion who were referred to the military medical board between 2016 and 2025.
Results: A total of 82 defendants were included in the study. Although a significant proportion of the participants had a history of substance use and a criminal record, no significant association was found between these variables and fitness for military service (p > 0.05). All individuals assessed as unfit for military service had a psychiatric diagnosis, with antisocial personality disorder and other personality disorders being the most common (p<0.001). No significant association was found between criminal responsibility and fitness for military service; the majority of the unfit group were found to have full criminal responsibility.
Conclusion: It is understood that the determination of fitness for military service in individuals who have committed the crime of desertion is largely related to psychiatric diagnoses; however, it must be assessed independently of criminal responsibility. Furthermore, it is believed that assessing criminal liability does not add much value in most cases and may prolong the trial process.
