Abstract

Avrupa Birliği (AB), 2005 yılında, “Gemilerden Kaynaklana Kirlenme ve İhlallere Yönelik Yaptırımların Uygulanması Hakkında 2005/35/EC sayılı Avrupa Parlamentosu ve Konsey Direktifi (2005/35/EC sayılı Direktif)”ni kabul etmiştir. Yürürlüğe girmesinden sonra Direktif’te çeşitli tarihlerde değişikliğe gidilmiştir. Bu kapsamda son değişiklik 27 Kasım 2024 tarihinde, (AB) 2024/3101 sayılı Avrupa Parlamentosu ve Konsey Direktifi ile yapılmıştır. 2024/3101 sayılı Direktif, özellikle, 2005/35/EC sayılı Direktif’in ihlaller ve yaptırımlara ilişkin maddelerinde önemli değişiklikler getirmektedir. Türkiye AB üyesi değildir. Dolayısıyla Direktif Türkiye bakımından bağlayıcı değildir. Bununla birlikte Türk Bayraklı gemiler AB limanlarını sıklıkla kullanmaktadır. Bu kapsamda çalışmada Türkiye’nin gemilerden kaynaklanan kirliliğe yönelik uygulamasının Direktif çerçevesinde değerlendirilmesi yapılmıştır.

TÜRKIYE'S ADMINISTRATIVE PENALTIES AGAINST SHIP-SOURCE POLLUTION WITHIN THE FRAMEWORK OF DIRECTIVE 2024/3101 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

Abstract

In 2005, The European Parliament and of the Council adopted Directive 2005/35/EC of the “On ship-source pollution and on the introduction of penalties for infringements – Directive 2005/35/EC)”. After its entry into force, the Directive 2005/35/EC had been amended on various dates. The last change was made on 27 November 2024 with Directive (EU) 2024/3101 of the European Parliament and of the Council of 27 November 2024 amending Directive 2005/35/EC as regards ship-source pollution and on the introduction of administrative penalties for infringements. Directive 2024/3101 introduces significant changes, in particular, to the articles of Directive 2005/35/EC on infringements and penalties. Türkiye is not a member of the EU. Therefore, the Directive is not binding for Türkiye. However, Turkish flagged ships frequently use EU ports. Thus, in this article, it was evaluated Türkiye's implementation of pollution from ships within the framework of the Directive.
