In today's contemporary democracies, freedom of expression is seen as one of the indispensable rights that ensure the progress of societies. Along with the technological developments in the field of communication, freedom of expression is also used through mass media, which we call new media today and whose effects go beyond the borders of the country. While this situation increased the effect of mass communication, on the other hand, it brought the issue of how to use freedom of expression in these environments and what the scope and limits of this right would be on the agenda of the whole world. While the new media rapidly increases its influence with different devices and techniques, legal rules cannot determine the scope and limits of the freedoms used in this environment at the same speed. When the different practices of each country in its own legal system are added to this, the relevant case-laws of the European Court of Human Rights have been examined in this study in order to determine the scope and limitation of freedom of expression in the new media. In our study, all legal texts on the subject were examined through content analysis and it was aimed to determine the scope and boundaries of this field. When we evaluate the data at hand, it is seen that the court sees the new media as independent from the physical world in its proceedings and tries to examine the new media within its own characteristics and make its decisions in this direction. In addition, court decisions impose responsibilities on journalists and new media users, apart from states and national judicial bodies, for the protection of freedom of expression in the new media.
