Roma III tüzüğü uyarınca boşanma ve ayrılığa uygulanacak hukukun tayini ve uygulanması

Abstract

Avrupa Birliği’nin (AB) kanunlar ihtilâfı hukuku alanındaki son düzenlemesi 20 Aralık 2010 tarihli Boşanma ve Ayrılığa Uygulanacak Hukuk Alanında Güçlendirilmiş İşbirliğinin Uygulanmasına İlişkin Konsey Tüzüğü’dür. Söz konusu Tüzük, akdî borç ilişkileri ile akit dışı borç ilişkilerine uygulanacak hukuk hakkında düzenleme getiren Roma I ve Roma II Tüzüklerini takiben, “Roma Rejimi”nin son düzenlemesi olarak “Roma III Tüzüğü” adıyla anılmaktadır. Roma III Tüzüğü, yabancı unsurlu boşanma ve ayrılık alanında uygulanacak kanunlar ihtilâfı kurallarına ilişkin ilk AB düzenlemesi olmasının yanı sıra, AB’de güçlendirilmiş işbirliğinin ilk örneğini teşkil etmesi bakımından da önemlidir. Düzenlemenin bir başka önemi ise, eşlerin, pek çok hukuk sisteminde görülmediği şekilde boşanma ve ayrılığa uygulanacak hukuku seçme imkânına sahip olmalarıdır. Bu çalışmada, Tüzüğün kabul süreci, önemi, amaçları ve uygulama alanı açıklandıktan sonra Tüzük hükümleri uyarınca uygulanacak hukukun tayini ve uygulanmasına ilişkin hususlar irdelenecektir. Kuşkusuz, Tüzük hükümlerinin ne şekilde yorumlanması ve uygulanması gerektiği, Tüzüğün uygulanmaya başlayacağı tarih olan 21 Haziran 2012’yi takiben gündeme gelebilecek Avrupa Birliği Adalet Divanı kararlarıyla şekillenecektir

Law Applicable to Divorce and Legal Separation Under Rome III Regulation

Abstract

The last regulation of the European Union (EU) in the area of private international law is the Council Regulation of 20 December 2010 implementing enhanced cooperation in the area of the law applicable to divorce and legal separation. The Regulation is also known as “the Rome III Regulation”, being the third instrument of the “Rome Regime” following Rome I and Rome II Regulations on the law applicable to contractual and non-contractual obligations, respectively. Rome III Regulation is significant because of not only being the first EU instrument providing for the law applicable to divorce and legal separation but also being the first example of the implementation of enhanced cooperation in the EU. The instrument is also important for allowing the spouses to choose the law applicable to divorce and legal separation. Following the explanations regarding the adoption of the Regulation, its importance, aims and scope of application, this article aims to examine the determination of the law applicable to divorce and legal separation under uniform rules of the Regulation. The interpretation and implementation of the provisions of the Regulation shall be shaped by the decisions of the Court of Justice of the EU following its application by 21st June 2012
