ULUSLARARASI HUKUKTA DENİZ HAYDUTLUĞU VE MÜCADELE YÖNTEMLERİ

Abstract

Son yıllarda deniz yolu taşımacılığına yönelik haydutluk faaliyetlerinde dikkat çekici bir artış yaşanmıştır. Öyle ki bu tür saldırıların yoğun bir şekilde görüldüğü bazı deniz alanları, haydutlar açısından güvenli bölge haline gelmiştir. Deniz haydutluğunun sebep olduğu ekonomik zarar, her yıl milyarlarca doları bulmaktadır. 1982 tarihli BM Deniz Hukuku Sözleşmesi’nde düzenlenen deniz haydutluğuna ilişkin uluslararası hukuk kuralları, uzun bir süredir değişmeksizin varlığını sürdürmektedir. Ancak söz konusu hukuki düzenlemeler, deniz haydutluğuna dair genel kabul görmüş bir tanımın yapılamayışı ve haydutların yakalanarak yargılanmaları gibi hususlarda ciddi eksiklikler içermektedir. Bu makalede deniz haydutluğuna ilişkin uluslararası hukuk kuralları, mücadele etkinlik açısından incelenmekte ve söz konusu eksikliklerin giderilmesine yönelik çözüm önerileri ortaya koyulmaktadır.

Piracy and Counter-Piracy in International Law

Abstract

Pirate attacks on shipping have increased notably in recent years. Certain waterways have become so notoriously vulnerable that the international community currently recognizes them as pirate havens. Maritime attacks cause billions of dollars in economic loss each year. The basic legal stipulations in international law, as embodied in the 1982 United Nations Convention on the Law of the Sea (UNCLOS), have remained unchanged for a long time. Nevertheless, the present legal regime suffers from serious shortcomings, such as the problem of adopting an agreed-upon definition of piracy and practical problems regarding arresting and prosecuting pirates. The goal of this paper is to examine and question the adequacy of the piracy related provisions of international law. This paper will also put forward specific recommendations as to how to remedy them
