Possibility of the Necessity Defense in Civil Disobedience Cases: Samples of the United States

Abstract

In a constitutional legal system in which human rights are violated, civil
disobedience has an important position to review and change the law. For this
reason, the right to necessity defense, which disobedient civil activists
contribute to the constitutional process, is of great importance. On the one
hand, the uncertainties about the discussions on civil disobedience, on the
other hand, the radical decisions of the American legal system concerning the necessity defense used by the militants in the cases of civil disobedience (in

particular indirect civil disobedience) constitute the focus of our study. In this
context, we have tried to express that compulsory defense will be used for
both direct and indirect actions.

Sivil İtaatsizlik Davalarında Zorunluluk Halinin Olanaklılığı: Amerika Birleşik Devletleri Örneği

Abstract

İnsan haklarının ihlal edildiği anayasal bir hukuk sisteminde sivil itaatsizlik, yasayı gözden geçirme ve değiştirme konusunda önemli bir konuma sahiptir. Bu nedenle anayasallığa katkı sağlayan sivil itaatsiz eylemcilerinin yargı önünde başvurdukları zorunlu savunma hakkı büyük önem teşkil etmektedir. Bir taraftan sivil itaatsizlik tartışmaları üzerindeki belirsizlikler, diğer taraftan Amerika hukuk sisteminin sivil itaatsizlik (özellikle dolaylı sivil itaatsizlik) davalarındaki eylemcilerin kullandığı zorunlu savunma hakkına yönelik verdiği radikal kararlar, çalışmamızın odak noktasını oluşturur. Bu bağlamda zorunlu savunmanın hem doğrudan hem de dolaylı eylemler için kullanılacağını ifade etmeye çalıştık.
