The Impact of the Death of One of the Parties on the Contract of Mandate in the Roman Law

Abstract

In Roman law, contract of mandate is an agreement that authorizes the mandatary to act on someone else’s account. As the contract of mandate is based on friendship and is gratuitous, it has a special place in the contracts system of the Roman law. Since the subject of contract of mandate is the execution of a commission and the trust element is the basis of the contract of mandate; the mandatary's personal characteristics, knowledge, skills and experience play an important role in this agreement. Therefore, there are two issues that need to be examined. These are mandatum morte solvitur and mandatum post mortem. According to the mandatum morte solvitur principle; the death of one of the parties terminates the contract of mandate since this contract is based on trust and friendship. When the issue of mandatum post mortem is examined, it is seen that the contract of mandate which will be executed after the death of the parties is invalid in Roman law. In the event of death of the mandatary, contract of mandate is expressed as “mandatum post mortem mandatarius” and in the case of the death of the mandator, the contract of mandate is expressed as “mandatum post mortem mandator”.

ROMA HUKUKU’NDA TARAFLARDAN BİRİNİN ÖLÜMÜNÜN VEKÂLET SÖZLEŞMESİNE ETKİSİ

Abstract

Roma Hukuku’nda vekâlet sözleşmesi, vekile başkasının hesabına hareket etmesi için yetki veren bir sözleşmedir. Vekâlet sözleşmesi, Roma Hukuku sözleşmeler sisteminde dostluğa dayanan ve ücretsiz yapılan bir sözleşme olması nedeniyle özel bir yere sahiptir. Vekâlet sözleşmesinin konusunun bir işin görülmesi olması ve vekâlet sözleşmesinin temelinde güven unsurunun yer alması sebebiyle; vekilin kişisel özellikleri, bilgisi, becerileri ve tecrübesi bu sözleşmede önemli rol oynar. Bu nedenle ele alınması gereken iki sorunsal bulunmaktadır. Bunlar, mandatum morte solvitur ve mandatum post mortem’dir. Mandatum morte solvitur prensibine göre; taraflar arasındaki güven ilişkisine ve dostluğa dayanan bir sözleşme olduğu için taraflardan birinin ölümü vekâlet sözleşmesini sona erdirir. Mandatum post mortem konusu incelendiğinde ise tarafların ölümünden sonra ifa edilecek vekâlet sözleşmelerinin Roma Hukuku’nda geçersiz sayıldığı görülmektedir. Roma Hukuku’na ilişkin kaynaklarda bu konu müvekkil ve vekil açısından ayrı ayrı incelenmiştir. Vekilin ölümü halinde ifa edilecek vekâlet sözleşmesi “mandatum post mortem mandatarius”, müvekkilin ölümü halinde ifa edilecek vekâlet sözleşmesi ise “mandatum post mortem mandator” olarak ifade edilmiştir.
