Hukuk Eğitiminde "Hukuk Etiği"

Abstract

Bu çalışmada, hukukçu kimliğinin oluşmasında hukuk eğitiminin temel belirleyici olduğuna ilişkin iddiadan yola çıkılarak, kabul edilmektedir. Bu kabule bağlı olarak hukuk eğitiminde hukuk etiği öğretiminin yeri ve önemi tartışılmaktadır. Hukuk eğitimi temel ve mesleki eğitim olarak ikiye ayrılmış ve bu ayrım çerçevesinde hukuk etiğinin hukuk eğitimindeki yeri analiz edilmiştir. Temel hukuk eğitiminde hukuk etiğinin yeri bölümünde, felsefi hukuk etiği ile hukuk felsefesindeki öncü yaklaşımlar referans alınmıştır. Bu doğrultuda hukuk eğitiminde hukuki pozitivist bakış açılarından dışlayıcı ve kapsayıcı hukuki pozitivist bakış açıları bağlamında hukuk etiği derslerinin içeriği değerlendirilmiştir. Dışlayıcı hukuki pozitivist perspektiften kurgulanan hukuk etiği eğitiminin kural temelli olmasının sakıncaları ortaya konulmuştur. Daha sonra kapsayıcı hukuk pozitivizm temelli hukuk etiği derslerinin felsefi hukuk etiğini içereceğini ve hukuk eğitimi alan kişilerin hukuk etiği farkındalığını arttırmada daha etkili olabileceği iddia edilmiştir. Çalışmanın ikinci bölümde hukuk meslek eğitimi içerisinde hukuk etiğinin yeri, felsefi hukuk etiği, hukuk etiği kodlarına dayanılarak ortaya konulmuştur. Gerek felsefi boyutuyla ve gerekse normatif boyutuyla hukuk etiği, hukukçu adaylarının hukuk eğitiminde ve hukukçuların (avukat, savcı hâkim, noter vb.) mesleki eğitimlerinin önemli bir parçası olduğu tespit edilerek çalışma sonlandırılmıştır.
