Hukuk Alanındaki Hizmetlerde Kullanılan Teknolojik Olanaklar (Legaltech) ve Avukatlık Mesleğine Olası Etkileri

Abstract

Basit düzeyli bilgi teknolojilerinin yardımıyla veritabanı araştırmasından blokzinciri tabanlı akıllı sözleşmelere, yapay zekâ veya otomasyon destekli hukuksal danışmanlıktan algoritmik hukukî veri işlemeye kadar uzanan geniş bir yelpazeyi kapsayıcı çeşitli yazılımsal gelişmeler, literatürde "LegalTech: Hukuk Teknolojisi" anahtar kelimesi altında özetlenmektedir. LegalTech’in esas amacı, hukuk alanındaki iş süreçlerinin desteklenmesi, otomasyonu ve hukuk hizmetlerinin tedarikini teknolojinin yardımıyla kolaylaştırmak ve hızlandırmaktır. LegalTech’in öneminin daha iyi anlaşılabilmesi için, sadece hukuk sisteminin ihtiyaçları hakkında öne sürülen teorik düzeydeki düşüncelerin tartışılması yetmez; aynı zamanda hukuk alanına yönelik teknik inovasyon imkânlarının mevcut hukuk düzenine nasıl entegre edilebileceği, hukuk pratiğinde işlevsel olarak hangi iyileştirmeleri sağlayabileceği, kapsam ve sınırlarının ne olması gerektiği de doğru analiz edilmelidir. LegalTech ile ilgilenen teknoloji şirketleri, daha ziyade geleneksel, muhafazakâr ve klasik iş görme anlayışının egemen olduğu hukuk alanındaki meslekî faaliyetlerin ve özellikle avukatlığın işleyişini düzenlemek amacıyla kurulan girişimler (start-up) olarak gitgide yaygınlaşmaktadır. Sözü edilen hukuk teknolojisi çözümleri, avukatlık ofislerinin ve kurumsal hukuk bürolarının meslekî anlamda daha başarılı ve verimli olmalarına katkı sağlayabilir. Fakat bunun için, öncelikle teknolojiye karşı olası önyargılardan kurtulmak, meslekî sorunların çözümü ve hizmet kalitesinin artırılması için teknolojinin hukuk alanına nasıl entegre edilebileceği üzerine kafa yormak ve nihayetinde teknoloji yardımıyla iş görme modellerinin temel öğelerini kavramak gerekmektedir.
