Hellenistik Dönem’de Kent Avukatlığı: Kos-Kalymna Örneği

Abstract

Makalede Hellenistik Dönem’de kent avukatlığı konusuna odaklanılmaktadır. Modern literatürde kent avukatları hakkında kapsamlı bir çalışma bulunmamaktadır. Yapılan çalışmalar çoğunlukla kentler arasındaki sorunlara odaklanmaktadır. Kent avukatlığı konusunu açıklayabilmek için Hellenistik Dönem’de kentler arasında görülmüş dava metinleri incelenmiştir. Öncelikle kent avukatlığı kavramının üzerinde durularak, kent avukatlarını tanımlamak için kullanılan çeşitli terimler açıklanmaktadır. Kent avukatları Hellenistik Dönem’de syndikos, ekdikos, proegoros, synegoros ve prodikos gibi ifadelerle anılmaktadırlar. Özünde hepsinin anlamı “bir şeyi ya da birini savunmak” olsa da bu çalışmada görev alanlarına göre sahip oldukları farklar açıklanmaktadır. Hellenistik Dönem’de kentler aralarında gelişen sorunları savaşla çözme yolundan uzaklaşıp, bunları üçüncü bir kent ya da şahsın hakemliğinde hukuk yoluyla çözmeye odaklanmaktadır. Dolayısıyla kent avukatlığı görevi bu kentlerde önemli bir konuma gelmiştir. Yazıtlar incelendiğinde söz konusu kişilerin sadece kendi kentlerini değil, bazen profesyonelce davranıp diğer kentleri de savundukları anlaşılmaktadır. Hellenistik Dönem’de, daha önceki dönemlerde de olduğu gibi, kentler arasında çoğunlukla arazi/sınır sorunlarına rastlanılmaktadır. Ancak bu ma-kalede kentler arasındaki borç sorununu konu edinen Kos ve Kalymna kentleri arasındaki bir davaya yer verilmektedir. Knidos kenti bu iki kent arasında hakemlik yapmıştır. Ayrıca tahkim davalarından yola çıkarak Hellenistik Dönem’de uluslararası ilişkilerin nasıl olduğuna değinil-mektedir.

City Advocacy in the Hellenistic Period: The Case of Kos-Kalymna

Abstract

This article focusses upon city advocacy in the Hellenistic period. There are no comprehensive studies on city lawyers in the modern literature. Studies mostly focus upon the problems between cities. In order to offer an explanation of city advocacy, case texts between cities in the Hellenistic Period were examined. Firstly, the concept of city advocacy is investigated with the various terms employed to define city lawyers. In the Hellenistic Period city lawyers were referred to by the words: syndikos, ekdikos, proegoros, synegoros, and, prodikos. Although in essence they all mean "defending something or someone", their dif¬ferences according to their field of duty are explained. In the Hellenistic Period, cities move away from solving problems between them through war and focus upon solving their problems through law with the arbitration of a third city or person. In consequence, the duty of the city lawyer reached an important position. When the inscriptions are examined, it is understood that these advocates not only defended their own cities, but also professionally defended other cities. In the Hellenistic Period, mostly land / border problems are encountered between cities. However, this article includes the case between the cities of Kos and Kalymna, which concerns a debt problem between these cities. The city of Knidos was the referee between these two cities. In addition, starting with arbitration cases, mention is made of international relations in the Hellenistic Period.
