ACCORDING TO NATIONAL AND INTERNATIONAL LEGISLATION THE IMPORTANCE OF THE ANNUAL LEAVES SITUATION AND THE APPLICATIONS OF PUBLIC SUBCONTRACT WORKING MECHANIZM IN TURKEY

Abstract

In this article we emphasized shortly on the importance of annual leaves. After that we explained this subject according to national and international legislation. In this context the importance of the annual leaves and the situation in Turkey has been put forward within the frame work of the Ministry of Labour and Social Security’s recent research findings, dated 2009 and together with the international ocuments. Also this subject of our annual leave legislation is examined in the light of international legislation. Then another study is made for atypical (flexible), originating from the globalization, generally non secure short term working forms and discussions about annual leave rights seen in the public subcontract working mechanism, examined and tried to enlighten within the international legislation, supreme court and doctrine. At the last section, it is emphasized the increasing of contemporary vital importance of social states for the survival of peace, justice and development of nations and implementation of the social rights to decrease the damage to minimum against the labour that originated from the globalization which supports capital, to make sure the citizens survive a humanly life, to apply principles of social states, to preserve social, natural environment and working media and by this contemporary, vital importance and functions is emphasized.
