Right to Social Security of Refugees and Asylum Seekers
Abstract
Despite the existence of a contract relating to refugees under international law, this agreement is much more than a real refugees and asylum seekers they need social security rights they need. It also seems to have a holistic legislation for a long time when we look at the legislation that regulates the right of asylum in Turkey. The law on foreigners that came into force in 2014 is a step taken to remedy this lack. However, even in that law, Turkey maintains the geographical limitations reservation that it put on the 1951 Convention on Refugees. Turkey's geographical limitation continue to impede the solution of problems in this regard. In particular, social security rights in the context of the 5510 Act has not been given to refugees while giving place to the refugee definition reinforces the concept of discrimination in this regard. Sığınmacıların ve Mültecilerin Sosyal Güvenlik Hakkı
Abstract
Uluslararası hukukta mültecilere ilişkin bir sözleşmenin bulunmasına rağmen, bu sözleşmenin çok daha ötesinde mülteci ve sığınmacıların daha belirgin şekilde düzenlenmiş sosyal güvenlik haklarına ihtiyaç duydukları bir gerçektir. Ayrıca Türkiye’de iltica hakkının düzenlendiği yasal hükümlere bakıldığında bütüncül bir mevzuatın uzunca bir süre bulunmadığı görülmektedir. 2014 yılında yürürlüğe giren Yabancılar Kanunu bu eksikliği gidermek açısından atılan önemli bir yasal adımdır. Bununla birlikte Türkiye söz konusu Yasada 1951 tarihli mülteciler hukukuna ilişkin sözleşmeye koyduğu coğrafi sınırlama çekincesini korumuştur. Türkiye’nin coğrafi sınırlamayı sürdürmesi, bu konudaki sorunların çözümüne engel olmaktadır. Özellikle sosyal güvenlik hakları bağlamında 5510 sayılı Kanunda mülteci tanımına yer verilirken sığınmacı kavramına yer verilmemiş olması bu konudaki ayrımı pekiştirmektedir. Her ne kadar konu ile ilgili çıkarılan Genelgeler bu ayrımı ortadan kaldırmaya çalışmış olsa da, çıkarılan genelgeler tam olarak sığınmacıların sosyal güvenlik haklarını karşılamamaktadır. Çünkü çıkarılan Genelgeler daha çok Suriye ve Irak sığınmacılarını kapsamaktadır. Bu nedenle mülteci ve sığınmacı ayrımını sosyal güvenlik hukuku anlamında da kanuni düzenlemelerle ortaya koymak yerinde olacaktır.
