Juridical Development Process of the Organisation Struggle of the Public Employees: Law No. 6289 and Its Effects on the Union Rights
Abstract
Importance of the government employee unions protecting the professional, economical, societal and cultural rights and interests of the public employees in Turkey are increasing gradually. The functional structure of the public employees in the connection point between the government and the citizens has made the public employees important in terms of societal development and welfare. Syndication and organising of the public employees have encountered various preclusions and hindrances in Turkey as it were in the rest of the world throughout history. The frame of working relations and societal roles that the public employees established with the government have led to the result that they became different than the other workers. In this study, , the last legal status that the union rights of the public employees have reached with the regulations implemented with the law no. 6289 is examined by researching the organisation struggle of the public employees in Turkey, in the historical development process with its juridical dimension . The status, which has emerged due to the delay of organization process of public unionism, has gone in civil servants’ favour by means of international texts and strengthened the process of progress of public unionism. Removing the restrictions on the union activities, which are secured with international documents in line with the union rights of the civil servants and elaborating public unionism in a way to cover all civil servants and bringing the social dialog mechanism into effect, are the important points that stand out for development of Turkish public unionism.

Türkiye’de Kamu Çalışanlarının Örgütlenme Mücadelesinin Hukuksal Gelişim Süreci: 6289 Sayılı Kanun ve Sendikal Haklara Etkileri
Abstract
Türkiye’de kamu çalışanlarının mesleki, iktisadi, toplumsal ve kültürel haklarıyla çıkarlarını korumak için kurulan kamu çalışanları sendikalarının önemi günümüzde gittikçe artmaktadır. Kamu çalışanının, devlet ile vatandaş arasındaki bağlantı noktasında şekillenen fonksiyonel yapısı, kamu çalışanlarını toplumsal gelişim ve refah açısından önemli kılmıştır. Tarih boyunca Dünya genelinde olduğu gibi Türkiye’de de kamu çalışanlarının örgütlenerek sendikalaşmaları çeşitli engelleme ve kısıtlamalarla karşılaşmıştır. Kamu çalışanlarının devlet ile oluşturdukları çalışma ilişkilerinin çerçevesi ve toplumsal rolleri onların diğer çalışanlardan farklı bir durumda olması sonucunu ortaya çıkarmıştır. Bu çalışmada, Türkiye’de kamu çalışanlarının örgütlenme mücadelesi tarihsel gelişim süreci içerisinde hukuksal boyutu ile araştırılarak, 6289 sayılı kanun ile yapılan düzenlemelerle, kamu çalışanlarının sendikal haklarının geldiği en son yasal durum incelenmiştir. Kamu sendikacılığının örgütlenme sürecinin gecikmesi ile ortaya çıkan durum uluslararası metinler vasıtasıyla kamu çalışanlarının lehine dönmüş ve kamu sendikacılığının ilerleme sürecini güçlendirmiştir. Kamu çalışanlarının sendikal hakları doğrultusunda uluslararası belgelerle güvence altına alınan sendikal faaliyetler üzerindeki kısıtlamaların kaldırılması, kamu sendikacılığının bütün kamu çalışanlarını kapsar nitelikte genişletilmesi ve sosyal diyalog mekanizmasına işlerlik kazandırılması Türk kamu sendikacılığının gelişimi için önemli noktalar olarak ön plana çıkmıştır.
