An Analysis Upon Union Rights of Turkish Armed Forces Staff in The Framework of Labour Relations

Abstract

In recent days, employment relations which have a trend of rapid transition and development, provides the right of collective action that is still one of the most fundamental rights for employees. The second paragraph of constitution provision 51 of the Constitution of the Republic of Turkey, the trade union rights may be restricted because of some reasons are given. Within the scope of the study, the restrictions imposed on the union rights and freedoms of the personnel who are working for different positions and who are in different status are tried to be discussed and examined in terms of both national laws and the laws on which the Turkish Armed Forces is dependent by analyzing the personnel structure of the Turkish Armed Forces.

Çalışma İlişkileri Çerçevesinde Türk Silahlı Kuvvetleri Personelinin Sendikal Hakları Üzerine Bir İnceleme

Abstract

Günümüzde hızlı bir şekilde değişim göstererek gelişen çalışma ilişkileri içerisinde örgütlenme hakkı ve örgütlü mücadele hakkı çalışanlar açısından en temel haklardan biri olmaya devam etmektedir. Türkiye Cumhuriyeti Anayasasının 51. Maddesinin ikinci fıkrasında, sendikal hakların bazı sebeplerden dolayı kısıtlanabileceği belirtilmiştir. Bu sebeplerden bir tanesi de ulusal güvenliktir. Çalışma içerisinde Türk Silahlı Kuvvetleri’nin personel yapısı incelenmeye çalışılarak, farklı kadrolar karşılığında çalışan farklı statülerdeki personelin hem ulusal kanunlar hem de Türk Silahlı Kuvvetleri’nin tabi olduğu kanunlar açısından sendikal hak ve özgürlüklerine getirilen kısıtlamalar ele alınmış ve incelenmeye çalışılmıştır.
