Foundation of Minority Fiqh
Abstract
Political turmoil and economic crises in the Islamic world forced people to migrate. As a result, the population of Muslims in continents such as Europe has increased and is increasing. This situation has brought the minority jurisprudence to the agenda in countries where Muslims live as a minority. Because in foreign countries, Muslims are stuck between the religion they belong to and the laws of the country they are subject to. The reasons for minority fiqh, which was tried to be created by being inspired by the law of dar al-Islam and dar al-harb, which was created in the context of international relations in the history of Islam; It can be summarized as Islam being the last religion sent to humanity, having universal va-lues that can produce fiqh in every age and geography, and establishing good relations with the environment in which Islam, the religion of peace, lives. The main reference point of minority fiqh is the re-evaluation of the fiqh legacy by taking in-to account the realities of the age, and the principle of maslaha, in which ijtihad is practiced after nas and qiyas.
